Terms and Conditions of Sale

CRYOSOCKS

1. PURPOSE AND SCOPE
CRYOSOCKS (hereinafter the "Company") designs and manufactures FREEPADS, cryotherapy products for muscle recovery, specifically intended for athletes and sport professionals. These products are sold wholesale or retail to professionals and individual consumers via the e-commerce platform: https://freecoveryshop.com (hereinafter the "Site" or the "Platform").

The Platform allows users (hereinafter the "Customer") to purchase the Company’s products (the "Products") online.

These Terms and Conditions of Sale (the "Terms") govern the online sale and delivery of Products ordered through the Platform. By ordering Products on the Platform, the Customer acknowledges and agrees to be bound by these Terms.

If the Customer does not accept all or part of these Terms, they must refrain from using the Platform. Specific terms may supplement these Terms before any transaction with the Customer. In such cases, specific terms shall prevail in case of conflict.

The applicable version of these Terms is the one in force on the date the order is placed. If modified, the new version will require the Customer’s acceptance before confirming any new order.

These Terms also apply to sales of Products at special events (e.g., sports events, conventions, trade shows), in which case they may be signed in paper format.

2. DEFINITIONS

  • "Customer" or "User": The person placing an order through the Platform.

  • "Terms" or "Terms and Conditions": These Terms and Conditions of Sale.

  • "Parties": Refers collectively to the Company and the Customer.

  • "Platform/Site": The online store where Products can be viewed and ordered.

  • "Products": Cryotherapy-based muscle recovery products offered by the Company.

  • "Company": CRYOSOCKS, creator and owner of the Products and Platform.

  • "Payment Terminal": The payment system used by the Company to process online payments.

3. ACCEPTANCE AND ENFORCEABILITY
The Customer agrees to comply with these Terms before using the Platform or ordering any Products. In the event of a conflict between these Terms and other statements on the Platform, these Terms prevail.

By ordering Products, the Customer confirms having all necessary information regarding the Products and accepts these Terms without reservation.

These Terms may be updated at any time by the Company to reflect changes in services or Products. Updated Terms must be accepted by the Customer with each new order.

These Terms apply from the moment the Customer places an order and remain binding unless otherwise agreed in writing.

The Customer may stop using the Platform at any time but remains responsible for previous use.

4. PLATFORM FUNCTIONALITY AND PRODUCT SALES
Products available for sale are listed on the Site at the time of the order. The list may change based on inventory.

Orders placed during events (e.g., trade shows) will be based on Products listed on the Site and paid using the Company’s accepted methods (e.g., credit card via Payment Terminal). The Company will confirm such orders by email.

Product descriptions, specifications, illustrations, and dimensions are available on the Site. Customers must review this information before placing an order.

The Customer is solely responsible for their purchase decisions. Product images are not contractually binding.

Products are sold via the Site, except when sold at in-person events. Delivery is available in mainland France and Corsica. For overseas territories or international delivery, Customers must inquire at contact@freecoveryshop.com.

Standard delivery time for France (including Corsica) is thirty (30) business days from the order date. Overseas delivery terms will be provided case by case. The Company may refuse international deliveries.

If international delivery is not possible, the Customer will be refunded within fourteen (14) days.

For deliveries outside mainland France, the Customer is considered the importer. Prices for exports outside the EU or overseas territories are exclusive of VAT. Customs duties and local taxes may apply and are the Customer’s responsibility.

5. PAYMENT TERMS

  • 1 FREEPAD with 2 FREECAPS : $198.00, including 2 FREEPADS, 2 FREECAPS.

  • 2 FREEPADS with 2 FREECAPS : $380.00, including 2 FREEPADS, 2 FREECAPS.

  • 2 FREECAPS : $32.00.
  • 4 FREECAPS : $60.00.

  • 6 FREECAPS : $80.00.

6. ORDERING PROCESS
The Customer selects Products, adds them to the cart, and proceeds to checkout. Shipping fees are calculated before payment.

Before payment, the Customer must check the box confirming acceptance of the Terms. Payment is made via the Payment Terminal. Order confirmation is sent by email.

A valid order forms a distance contract between the Customer and the Company. The Company may cancel orders with prior payment issues or incomplete customer details.

Product prices are listed in Euros, including VAT but excluding shipping and customs. The Company may issue discount codes at its discretion. Prices may change at any time but are fixed for confirmed orders.

7. DELIVERY
Products are delivered to the address indicated by the Customer. Delivery in France is generally within 30 business days. International delivery depends on confirmation from the Company.

The Company is not liable for delays under fifteen (15) business days. In case of longer delays, the Customer may cancel the order per legal procedures.

If no one is available to receive the package, the delivery company will leave instructions. After a second failed attempt, the delivery will be rescheduled at the Customer’s expense.

The Products remain the Company’s property until full payment is received. Risk transfers to the Customer upon physical delivery.

8. RIGHT OF WITHDRAWAL (FOR CONSUMERS)
Non-professional Customers have a legal right to withdraw within fourteen (14) days of delivery without penalty.

Returned Products must be in original, unused condition with packaging and instructions. Refunds cover Product cost and standard delivery only; return shipping is at the Customer's expense.

The withdrawal form is provided in Annex 1. Refunds are made within fourteen (14) days of notice of withdrawal.

9. WARRANTIES AND LIABILITY
Products are covered by legal guarantees:

  • Conformity (Article L217-4 to L217-14 of the French Consumer Code)

  • Hidden defects (Articles 1641 to 1649 of the French Civil Code)

  • Product liability for defective goods

To invoke warranty, Customers must notify the Company in writing within seven (7) days of delivery and return defective Products.

Warranty does not apply in cases of misuse, negligence, or non-compliance with instructions, especially regarding cold capsules, which contain pressurized gas and must be handled with care.

The Company’s liability is limited to replacing or refunding defective Products.

10. DATA PROTECTION
Personal data is processed in accordance with the French Data Protection Act and the EU General Data Protection Regulation (GDPR).

Data is used for order processing, customer support, and marketing. Customers have the right to access, rectify, delete, and port their data by contacting the Company at contact@freecoveryshop.com or by registered mail.

11. INTELLECTUAL PROPERTY
The Company owns all intellectual property rights to the Platform and Products. Any reproduction or use of its content or brand without authorization is strictly prohibited.

12. CUSTOMER SERVICE AND SUPPORT

13. GOVERNING LAW AND DISPUTES
These Terms and any resulting sales contracts are governed by French law. In case of dispute:

  • Consumers may use mediation (see Article L612-1 of the Consumer Code).

  • Non-consumers agree to exclusive jurisdiction of the Commercial Court of Montpellier.

14. MISCELLANEOUS
Any failure by the Company to enforce a provision does not constitute a waiver.

If any provision of these Terms is held invalid, the remaining provisions remain in effect.

Any modifications will be submitted for Customer acceptance during future purchases.
